TULSA, OK — An Oklahoma teenager is swept up in laws aimed at protecting kids from child predators.  He must register as a sex offender for life, as the worst level offender, after having a sex with his girlfriend, who said she was his age, 16.  Sex between teenagers is no longer just a moral issue, it’s a legal one.

Dothan teenager faces multiple sexual assault charges involving a 15-year-old girl after police arrested him Friday.

 Investigators arrested Caleb Blake Brooks, 18, of Robindale Drive, and charged him with 10 felony counts of second-degree rape. Brooks was released from the Houston County Jail on Friday after he posted a $15,000 bond.

Dothan Police Capt. Larry Draughon said the rapes happened over the past several months. “It was with her consent, but she was unable to give consent because of her age. We got a statement out of him that confirmed the activity,” Draughon said. “It happened in cars and other places but never at his place of employment.” Houston County District Attorney Doug Valeska said there has been an increase of second-degree rape cases in the judicial district, which includes Henry County.

 According to Dothan City Jail records, Brooks works at Calvary Baptist Church. Draughon said Brooks was employed as a kind of teacher’s aide in the education part of the church. Pastors at the church could not be reached to specify Brooks’ employment.

Brooks could face between two and 20 years in prison per charge if convicted of the Class B felony. Valeska said people convicted of sex crimes, including second-degree rape, would be required to follow the state registered sex offender laws, which prohibit them from working or being around children.

 “The defendant is going to have a record, and they’re going to have to register as a sex offender,” Valeska said. Valeska said much of the problem has included teenagers who claim they didn’t know it was against the law. He said if the girl is over the age of 12 and under 16, she can not consent to a sexual act. Valeska said lawyers in his office will be willing to speak with area organizations, including schools, to explain the law on the second-degree rape.

“The teenagers need to be instructed and taught,” Valeska said. “They need to know what the law is pertaining to rape second. If you’re at least two years older it’s rape second-degree.”

Two must see videos on JSO treatment

There are two videos describing abusive JSO treatment on Youtube. These are TV news reports from 1993 of an abusive treatment program at Columbia University in NY. The first report also refers to the abusive Phoenix treatment program. The reports talk about the use of plethysmographs and aversion therapy on children and teenagers, and include an interview with a teenager who became suicidal and then sued the program for 10 million dollars.

North Dakota Attorney General Warns Teens About Sex

See this brochure from the North Dakota attorney general’s office. At least they’re making a small attempt to warn teens:

“Decisions you make about sex will affect the rest of your life. The
wrong decision can have devastating consequences - for you,
your partner, and your family.

You may end up studying at home with a tutor instead of
hanging out with your friends at school. If you still have
friends - their parents may not let them hang out with a convicted
sex offender.

The conviction is part of your criminal record, which never
goes away. When you apply for a job or want to rent an
apartment, your future employer or landlord may run a
criminal history record check. If they do, they will see the sex
offense - it may cost you the job or the apartment.

In North Dakota, a person can be charged with a serious crime if he or
she engages in a sexual act or sexual contact with a minor and is at
least three years older than the minor. The seriousness of the crime
and the penalties are even greater if the minor is under 15 years of age
and there is no requirement that the person be at least three years older
than the minor.

If you are 18, you are considered to be an adult - even if you are still
in high school. Anyone younger than 18 is a “minor.” A minor
cannot legally “consent” to engage in sexual contact or perform a
sexual act.

The law does not make an exception just because you are in love.

Even if your boyfriend or girlfriend wants to have sex with you,
your friend’s parents can still have you arrested and charged with a
crime if they find out.”

Children Take Action Where Adults Fear to Tread

STUDENTS TAKE A STAND TO PROTECT THEIR PEERS

April 6, 2007 Glendale, AZ: This week a handful a Phoenix eighth graders took a stand to make a difference, possibly saving many youth from spending a lifetime as registered sex offenders.  Students at Desert Sky Middle School handed out (these) fliers and posted them throughout the school in an effort to educate their fellow classmates of the dangers they face in an overzealous system mandated by Arizona Legislators. The fliers were gleaned from a report made by a Maricopa County Juvenile Public Defender, whose name will not be released for fear of retaliation. As a side note, this public defender had no knowledge or involvement in the passing out of the fliers. These students were outraged and angered, not to mention surprised by the information the fliers contained and rightfully so. Although the students that handed out the fliers have not been identified by school authorities, school officials took immediate steps to remove the fliers as quickly as possible. Many demanded to know “who” was responsible for disseminating the information. 

One teacher was quoted as saying she “didn’t think the information was true.” Unfortunately, it IS true and that was the point students were trying to drive home. Perhaps if enough students and parents were made aware of the facts contained in the flier more could be done to prevent youths being swept up in a system gone out of control. Effective changes made and young lives would not be needlessly destroyed.
